These terms cover your use of the init.Habits iOS app (the "app") and the inithabits.com website (the "website"), an independent product developed and operated from the Netherlands.
By installing or using the app, or by using the website, you agree to these terms. If you don't agree, please don't use the app or the website.
You may install and use the app on devices you own or control, for personal use. The app is intended for personal habit tracking — not for medical, clinical, or professional decision-making. Don't rely on it as a substitute for advice from a qualified professional.
You agree not to reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent expressly permitted by law. You agree not to redistribute the app, sell it, or use it to build a competing product. You agree not to use the app or the website to harm others, transmit malicious content, or violate any law.
The app is free to use within the limits of the free tier. A Pro tier unlocks additional features (more habits, more routines, custom themes, custom icons, and more) for a recurring subscription fee.
All subscription purchases are processed through Apple's In-App Purchase system. Pricing, billing dates, and your active subscription status are managed by Apple. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
To cancel your subscription, manage it in your iOS Settings or in the App Store. Cancellations take effect at the end of the current billing period — Pro features remain available until then.
Refund requests must be made through Apple. We don't process refunds directly. See Apple's refund policy at reportaproblem.apple.com.
The following terms apply specifically to your use of the app as distributed through the Apple App Store, and are required by Apple.
These terms are between you and us. Apple is not a party to these terms and is not responsible for the app or its content.
We are solely responsible for any maintenance and support for the app. Apple has no obligation to provide either.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable). To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
We, not Apple, are responsible for addressing any claims you or a third party may have relating to the app — including product liability, failure to meet legal or regulatory requirements, consumer protection, privacy, or any claim arising from the app's use of HealthKit data.
If a third party claims the app infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
You represent and warrant that you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
You agree to comply with any applicable third-party terms when using the app (for example, your wireless data plan terms).
You acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these terms, and that Apple has the right (and is deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
Your habit data is yours. It's stored locally on your device and, if you've enabled iCloud sync, in your personal iCloud account. We don't access it.
A small amount of anonymous data (analytics, feedback you choose to send us, your email if you signed up via the website) is handled as described in our privacy policy.
The app and the website are provided "as is" and "as available" without warranties of any kind. We don't promise the app will be free of bugs, available 24/7, or that habit data will never be lost — please keep iCloud sync enabled if your data matters to you. We don't promise the app will work on every iOS version or device.
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the app or the website. Our total liability is limited to the amount you have paid us through Apple in the past twelve months — for free users, that's zero.
The init.Habits name, branding, design, and source code are owned by us. Using the app does not grant you any rights to the name, branding, or source.
You can stop using the app at any time by deleting it. Cancelling your Pro subscription is described in the subscriptions section above.
We may suspend or terminate your access to the app or website if you violate these terms, attempt to harm others through the app, or attempt to abuse our infrastructure. We may also discontinue the app, the website, or any feature at any time.
These terms are governed by the laws of the Netherlands. Any disputes will be resolved in Dutch courts. If you are a consumer in the EU, you also have the rights granted by your local consumer protection laws — these terms do not override those.
We may update these terms from time to time. When we do, we'll update the date at the top of this page. Continued use of the app or website after changes are posted means you accept the updated terms.
