what this is
These terms cover the init.Habits iOS app (the "app"), the init.Habits web app at app.inithabits.com (the "web app"), and the inithabits.com website (the "website") — together, "init.Habits" or "the service" — an independent product developed and operated from the Netherlands by Vladyslav Glogus.
By installing or using the app, using the web app, or using the website, you agree to these terms. If you don't agree, please don't use them.
You must be at least 16 years old to use the service or to hold an init.Habits account.
accounts
You can use the iOS app on its own, with your data staying on your device, without an account. To use the web app, or to sync your data across devices, you create an init.Habits account — either with Sign in with Apple, or (on the web) with an email address and password.
You are responsible for keeping your login credentials secure and for activity that happens under your account. Please use an accurate email address so we can send you account and security messages. An account is for one person — don't share it or let others sign in as you.
You can delete your account at any time from the app's sync & data settings, which removes your synced data from our server. We may suspend or terminate an account that violates these terms or abuses the service.
using the app
You are granted a non-transferable license to install and use the app on Apple-branded products that you own or control, subject to the Usage Rules in the Apple Media Services Terms and Conditions. The app may also be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
init.Habits is intended for personal habit tracking — not for medical, clinical, or professional decision-making. Don't rely on it as a substitute for advice from a qualified professional.
You agree not to reverse engineer, decompile, or attempt to extract the source code of the app or web app, except to the extent expressly permitted by law. You agree not to redistribute the app, sell it, or use it to build a competing product. You agree not to use the app, the web app, or the website to harm others, transmit malicious content, or violate any law.
subscriptions
init.Habits is free to use within the limits of the free tier. A Pro tier unlocks additional features (more habits, more routines, custom themes, custom icons, and more) for a recurring subscription fee. Cloud Sync and iCloud Backup are no longer Pro features — they are available to everyone.
On iOS, subscription purchases are processed through Apple's In-App Purchase system. Pricing, billing dates, and your active subscription status are managed by Apple. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. To cancel, manage your subscription in your iOS Settings or in the App Store.
On the web, subscription purchases are processed by Paddle, acting as our merchant of record (the seller of record for web purchases, responsible for billing and applicable taxes such as VAT). Web subscriptions auto-renew until cancelled. To cancel, use the manage-subscription link in your account or in any Paddle receipt email.
Your Pro entitlement is unified across platforms through RevenueCat, so a subscription purchased on one platform applies on the other under the same account.
We may change subscription prices from time to time. Price changes apply to future billing periods, and where required by law we will notify you in advance so you can decide whether to continue.
Any promotional or discount codes are optional, may be limited in number or time, may be withdrawn, have no cash value, and cannot be exchanged for money.
Refunds and EU withdrawal rights: our refund policy applies. In short, Pro comes with a 30-day money-back guarantee; web refunds are handled by Paddle, and iOS refunds by Apple. If you are a consumer in the EU or UK, you have a statutory 14-day right of withdrawal for digital purchases — by starting to use Pro immediately after purchase you ask us to begin providing it right away, and in any case our 30-day guarantee is more generous than the statutory minimum.
app store terms
The following terms apply specifically to your use of the app as distributed through the Apple App Store, and are required by Apple.
These terms are between you and us. Apple is not a party to these terms and is not responsible for the app or its content.
We are solely responsible for any maintenance and support for the app. Apple has no obligation to provide either.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable). To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
We, not Apple, are responsible for addressing any claims you or a third party may have relating to the app — including product liability, failure to meet legal or regulatory requirements, consumer protection, privacy, or any claim arising from the app's use of HealthKit data.
If a third party claims the app infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
You represent and warrant that you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
You agree to comply with any applicable third-party terms when using the app (for example, your wireless data plan terms).
You acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these terms, and that Apple has the right (and is deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
your data
Your habit data is yours. It's stored locally on your device or in your browser. If you enable Cloud Sync (free), it's also stored on our server in the EU so it can sync across your devices and power the web app; you can turn that off at any time, which deletes it from our server. On iOS you can also enable iCloud Backup (free), which stores it in your personal iCloud account — we have no access to it there.
You can export your data at any time using the in-app backup. Your account data, analytics, feedback you choose to send us, and your email if you signed up via the website are handled as described in our privacy policy.
feedback
You can send us feedback, including messages and screenshots, from within both the iOS app and the web app. Feedback you send is transmitted to and stored on our server in the EU, and is used solely to read and process your request and to improve init.Habits. By sending feedback you grant us permission to use it for that purpose. Don't include anything in feedback that you don't want us to have, and don't send content that is unlawful or that you don't have the right to share.
themes marketplace
The app includes a themes marketplace where you can optionally publish a custom theme for other users to browse and download. Publishing is entirely your choice — if you don't publish anything, this section doesn't apply to you.
You keep ownership of any theme you create. By publishing a theme, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that theme — together with the username you choose at submission — within init.Habits, so other users can find and download it. This license lasts until you unpublish the theme. You can unpublish at any time, which removes the theme and the attached username from our server.
You are responsible for what you submit. You must only publish themes you created, and the username and theme name you choose must not be offensive, misleading, unlawful, infringing on anyone else's rights, or impersonate another person or brand. The username you submit is shown publicly next to your theme.
We may decline to publish, or may remove, any theme or username — at our discretion and without notice — that we believe violates these terms, infringes someone's rights, or is the subject of a complaint. The marketplace is provided as-is, and we don't guarantee that any published theme will remain available.
fine print
The app, the web app, and the website are provided "as is" and "as available" without warranties of any kind. We don't promise the service will be free of bugs, available 24/7, or that habit data will never be lost — if your data matters to you, enable Cloud Sync or iCloud Backup (both free). We don't promise the app will work on every iOS version, browser, or device.
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you have paid us for init.Habits Pro in the past twelve months (through Apple or Paddle) — for free users, that's zero.
The init.Habits name, branding, design, and source code are owned by us. Using the service does not grant you any rights to the name, branding, or source.
general
If any part of these terms is found to be unenforceable, the rest stays in effect. These terms, together with our privacy and refund policies, are the entire agreement between you and us regarding the service. Our failure to enforce any provision is not a waiver of it.
You may not transfer your rights or obligations under these terms to anyone else. We may transfer ours to a successor if we restructure, sell, or otherwise transfer the service. We are not responsible for delays or failures caused by events beyond our reasonable control.
termination
You can stop using the app or web app at any time by deleting the app or signing out and deleting your account. Cancelling your Pro subscription is described in the subscriptions section above.
We may suspend or terminate your access to the service if you violate these terms, attempt to harm others through it, or attempt to abuse our infrastructure. We may also discontinue the app, the web app, the website, or any feature at any time.
governing law
These terms are governed by the laws of the Netherlands. Any disputes will be resolved in Dutch courts. If you are a consumer in the EU, you also have the rights granted by your local consumer protection laws — these terms do not override those.
developer
The service is operated by Vladyslav Glogus, based in the Netherlands. For end-user questions, complaints, or claims relating to the app, the web app, or the website, contact hello@inithabits.com.
changes
We may update these terms from time to time. When we do, we'll update the date at the top of this page. Continued use of the service after changes are posted means you accept the updated terms.
